As a highly skilled and experienced Commercial Manager for the Taymouth Castle project you play a key role in managing and optimising our commercial agreements and contracts, ensuring that they align with business objectives and comply with legal requirements. The Commercial Manager will work within a small project team employed full time directly by the project and working on behalf of the project investor and collaborate with various stakeholders, negotiate terms and proactively identify opportunities for improvement in our contractual relationships to ensure exceptional standards of delivery.

 

Key Responsibilities

  • Manage and oversee all commercial related aspects for a large portfolio of projects such as Taymouth Castle, properties in Kenmore Village, Glenlyon (Farm & Estate) and other DLC properties in the local area.
  • Manage and oversee budgets, cost estimates, cost plans, bills of quantities, tender documents, tender check and report, value engineering, variations, monthly valuations, periodic cost reports and agreement of final accounts.
  • Effectively negotiate favourable contract terms and conditions for consultancy agreements and building contracts with consultants, contractors, and vendors to ensure contracts are executed in a timely and efficient manner and to a high standard in conjunction with Development Team leads while maintaining positive relationships.
  • Professionally liaise with Solicitors to ensure final negotiated contracts are endorsed and comply with legal requirements, company policies, insurances, and industry standards before issuing to legal dept.
  • Stay abreast of changes in relevant laws and regulations affecting contracts and commercial agreements ensuring full compliance with company commercial policies and corporate governance.
  • Proactively seek improvements to commercial procedures and contract management processes to enhance efficiency.
  • Identify and assess potential project associated risks and develop mitigation strategies as necessary.
  • Provide advice on contractual claims and disputes in conjunction with consultants.
  • Implement best practices and contribute to the development of standardised contract templates.
  • Provide advice and knowledge on suitable procurement routes to suit project needs.
  • Collaborate with internal departments such as finance, sales, and operations for any commercial and contract related issues.
  • Attend cost meetings to report on budget, estimate to completion, provide early warnings, variations, and provisional sum status in conjunction with VP of Development and Construction and VP of Finance and other third parties.
  • Support VP of Development and Construction with monthly budget updates, reporting and KPI’s.
  • Liaise with external stakeholders to ensure requests for budgets and cost estimates are carried out in a timely manner and costs are market tested and/or benchmarked to ensure best value for money.
  • Attend presentations with funders and justify queries in relation to cost, expenditure, or budgets in conjunction with VP of Construction & Development and VP of Finance.
  • Provide guidance on Provisional Sum & Prime Cost allowances to ensure a reasonable level of accuracy.
  • Participate with final tender negotiations.
  • Attend tender meetings to ensure all commercial related issues are addressed appropriately.
  • Provide contractual advice during the tendering process.
  • Provide feedback on consultants’ commercial tender evaluation report & recommendation.

 

Desired Qualifications and Experience

  • Proven experience over a number of years in Quantity Surveying, Commercial Management, particularly in mixed- use real estate, new build residential, hospitality and listed building developments.
  • Experienced in managing a team of Quantity Surveyors at Associate Director level with a consultancy or a developer.
  • Bachelor’s degree in Quantity Surveying or another related field.
  • Relevant professional certifications such as Chartered RICS or equivalent.
  • In-depth knowledge of contract law, commercial terms, and negotiation strategies combined with strong contractual experience to manage a wide range of contract conditions.
  • Excellent knowledge of the Scottish and UK market.
  • Proficient in IT and adeptness with relevant software applications
  • Ability to solve problems efficiently, excellent interpersonal and networking skills, with the ability to communicate effectively with all levels of personnel.
  • Strong analytical and problem-solving skills and written communication skills
  • Ability to effectively prioritise a busy workload and meet project deadlines.
  • Ability to manage and effectively collaborate with various departments and stakeholders to implement projects in a fast-paced environment.
